Construction Gamma Terms of Service

Welcome to Construction Gamma, an online platform providing curated AI workflows, skills, integrations, and resources for construction professionals, operated by Construction Gamma LLC (“Company”, “we”, “us”, “our”), a company registered in Massachusetts. By accessing or using Construction Gamma (“Service”, “Platform”), you agree to be bound by these Terms of Service (“Terms”).

01Acceptance of Terms

By creating an account, browsing, or using any feature of Construction Gamma, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

02Service Description

Construction Gamma provides a library of AI-related content for construction professionals, including:

  • Workflows — structured prompts and processes designed to be used with third-party AI platforms such as Claude, ChatGPT, and Microsoft Copilot.
  • Skills — downloadable instruction sets and supporting files designed to run inside third-party AI platforms.
  • MCPs — guides and configurations for connecting third-party AI platforms to other software tools and services.
  • Resources — curated educational content for learning and applying AI in construction.
  • Packages and My Library — features for organizing, saving, and accessing the above.

Content in the core library is curated and published by Construction Gamma. The Platform also provides tools for users to create their own content (the “Builder”) and to share content within their organization (“Organization Libraries”), as described in Sections 06 and 07.

Construction Gamma is not an AI platform itself. Content on the Platform is designed for use with third-party AI services, which are governed by their own terms and which we do not control.

03Account Registration

To use the Service you must create an account. You agree to:

  • Provide accurate and complete information, including using an email address you are authorized to use.
  • Keep your account credentials secure.
  • Notify us immediately of any unauthorized access.
  • Be responsible for all activity under your account.
  • Not share your account with others.

We reserve the right to suspend or terminate accounts that violate these Terms.

04Access and Plans

Access to the Service currently requires a free account. We may introduce paid plans, features, or subscription tiers in the future. If we do, pricing and billing terms will be presented at the point of purchase, and material changes affecting existing users will be communicated with at least 30 days notice.

05License to Platform Content

Subject to these Terms, Construction Gamma grants you a personal, non-exclusive, non-transferable license to access, download (where applicable), and use Platform content for your professional work in the construction industry.

You may not:

  • Redistribute, resell, sublicense, or republish Platform content outside the Service, except as expressly permitted by the sharing features of the Platform.
  • Use Platform content to build a competing product or marketplace.
  • Bulk-export or scrape the library.
  • Claim authorship of content you did not create.
  • Remove or alter attribution, branding, or notices.

This license does not transfer ownership of any content.

06User-Created Content (Builder)

The Builder allows users to create their own workflows, skills, and related content (“User Content”).

6.1Ownership

You retain ownership of User Content you create. You grant Construction Gamma a non-exclusive, worldwide, royalty-free license to host, store, display, and process your User Content as necessary to operate the Service, including making it available to you and to others you share it with through Platform features.

6.2Your Representations

By creating or uploading User Content, you represent and warrant that:

  • You have the legal right to create and share the content.
  • The content does not violate any agreement with your current or former employer, including any Confidentiality and Invention Assignment Agreement (CIIA), non-disclosure agreement, or similar obligation.
  • The content does not contain trade secrets, proprietary processes, or confidential information belonging to any third party that you are not authorized to share.
  • The content does not infringe any third party's intellectual property rights.

Construction Gamma does not review User Content for confidentiality, proprietary status, or accuracy. We strongly encourage you to review your employment agreements before creating or sharing content based on processes developed during your employment.

6.3Our Rights

We reserve the right to remove any User Content that violates these Terms or that is the subject of a credible third-party claim, and to suspend or terminate accounts responsible for violations.

07Organization Libraries

Organization Libraries allow users who share a verified company email domain to share content with one another.

7.1Domain-Based Access

Access to an Organization Library is determined by verification of your email domain. You may only join an Organization Library using a company email address you are currently authorized to use. Construction Gamma verifies email domains, not employment status, and does not guarantee that every member of an Organization Library is a current employee or authorized representative of the associated organization.

7.2Visibility

Content you contribute to an Organization Library is visible to all current and future members of that library. Do not contribute content you are not comfortable sharing with everyone who shares your email domain.

7.3Your Responsibility

A shared email domain does not by itself authorize the sharing of information. You are solely responsible for ensuring that anything you contribute to an Organization Library complies with your organization's internal policies and your own confidentiality obligations. The representations in Section 6.2 apply to all content contributed to an Organization Library.

7.4Relationship to Your Organization

Organization Libraries are provided as a service to individual users. Unless Construction Gamma has entered into a separate written agreement with an organization, the organization associated with an email domain is not a party to these Terms, has no administrative rights over the library, and has no contractual relationship with Construction Gamma.

7.5Departure and Removal

If your domain verification lapses, your account is terminated, or you are otherwise removed from an Organization Library, content you contributed remains available to the Organization Library.

7.6Excluded Domains

Public email providers (such as Gmail, Outlook.com, and Yahoo) and other shared or generic domains are not eligible for Organization Libraries. We reserve the right to exclude any domain, decline verification, or remove members at our discretion to protect the integrity of the feature.

08No Legal, Safety, Financial, or Professional Advice

All content on the Platform — whether published by Construction Gamma, created by users via the Builder, or shared through Organization Libraries — consists of productivity tools and educational material only. It is not legal advice, safety advice, financial advice, engineering advice, or professional guidance of any kind.

Construction professionals remain solely responsible for:

  • Verifying all AI-generated outputs against applicable building codes, contract documents, regulations, and professional standards.
  • Ensuring compliance with OSHA and all applicable safety regulations.
  • Reviewing all outputs before use on active projects.
  • Exercising independent professional judgment on all project decisions.

Construction Gamma is not liable for any project outcomes, regulatory violations, safety incidents, or financial losses arising from the use of any content on this Platform, regardless of who authored it.

09Confidential Information in AI Platforms

You are responsible for ensuring that any project data or information you input into third-party AI platforms when using Platform content does not violate your confidentiality obligations, your employer's policies, or applicable law. Construction Gamma does not control and is not responsible for how third-party AI platforms process the information you provide to them.

10Takedown Policy

If Construction Gamma receives a credible written notice that any content on the Platform contains proprietary, confidential, or infringing material belonging to a third party, we will:

  • Remove or restrict access to the content pending investigation.
  • Notify the user who contributed the content, where applicable.
  • Cooperate with any lawful legal process related to the claim.

Takedown notices must be submitted in writing to admin@constructiongamma.com and must include the claimant's identity, the specific content at issue, the nature of the claimed violation, and supporting documentation.

We reserve the right to permanently remove any content and terminate any account found to be in violation of these Terms.

11Indemnification

You agree to indemnify, defend, and hold harmless Construction Gamma LLC from any claims, damages, losses, liabilities, costs, and expenses arising from:

  • User Content you create or contribute.
  • Your violation of any employment agreement, CIIA, or confidentiality obligation.
  • Claims by your employer, former employer, or any third party related to content you contributed.
  • Any misrepresentation regarding your right to share content or your affiliation with an organization.

12Intellectual Property

All Platform content published by Construction Gamma, including the library content, design, logos, and branding, is owned by Construction Gamma LLC. User Content is owned by the users who create it, as described in Section 06. Your use of the Service grants you a license to use content as described in these Terms, not ownership of the underlying intellectual property.

13Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose.
  • Contribute confidential or proprietary information belonging to your employer, clients, or any third party without authorization.
  • Misrepresent your identity, email domain, or organizational affiliation, including to gain access to an Organization Library.
  • Attempt to gain unauthorized access to the Platform or to any Organization Library.
  • Scrape or collect data without permission.
  • Create multiple accounts to circumvent restrictions.
  • Share an account across multiple individuals.
  • Bulk-export the library.

14Limitation of Liability

To the maximum extent permitted by law, Construction Gamma LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including project outcomes, other users' violations of their employment agreements, third-party claims related to user-contributed content, unauthorized access to Organization Libraries resulting from email domain changes outside our control, or interruptions to the Service.

Our total liability in any 12-month period shall not exceed the greater of (a) the amount you paid to us in the preceding 12 months, or (b) fifty dollars ($50).

15Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind. We do not guarantee that any content will meet your specific project requirements. We do not review user-contributed content for quality, accuracy, or professional suitability.

16Modifications to Terms

We may update these Terms from time to time. For material changes we will provide at least 30 days notice by posting the updated Terms and notifying you by email.

17Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts. Any disputes shall be resolved in the courts of Massachusetts.

18Termination

We may terminate or suspend your account at any time for violation of these Terms. Sections 06, 07, 08, 09, 11, 12, 14, and 15 survive termination.
